McGahren, Gaskill & York, LLC’s employment department has experience in representing both individuals and companies with regard to the what we believe is one of the most important present day concerns of all: the law of the workplace. As the filing of employment lawsuits continues to escalate and state and federal law become even more complicated, the need for outstanding legal representation cannot be overstated. McGahren, Gaskill & York, LLC strives to build long term relationships with companies and businesses in need of advice on how to create preventative agreements and policy, as well as how to avoid opening the door for what would otherwise be a frivolous claim(s). McGahren, Gaskill & York, LLC also represents individuals whose rights under State or Federal law have been violated. Potential individuals should be cautioned, however, that while there are many wrongs that occur in the workplace or on the job, that many are still not actionable under state law (as the great bulk of employees are hired “at will.”) Therefore, because of the large number of inquiries made by individuals who believe they have been wronged, and because employment cases are generally more complicated than others and require more screening than usual, McGahren, Gaskill & York, LLC generally charges a minimal consultation fee to determine whether an individual case is actionable (sexual harassment cases, however, do not require a consultation fee). Furthermore, while companies and businesses are charged on an hourly basis, individual cases may or may not be taken on a contingency basis depending on the particular circumstances.
